ADVENTURE WAIVER

ASSUMPTION OF RISK & LIABILITY WAIVER

I, the undersigned participant (or parent/guardian of a minor), acknowledge and agree to the following terms and conditions for participation in adventure activities at The Sandbox Resort, Naro Moru, Nyeri County, Kenya.

1. NATURE OF ACTIVITIES

The activities offered by The Sandbox Resort include but are not limited to: high ropes courses, zip lines, giant swings, climbing walls, and night adventure experiences. These activities involve physical exertion, height, speed, and elements of risk inherent to outdoor adventure recreation.

2. ASSUMPTION OF RISK

I understand and acknowledge that participation in adventure activities carries inherent risks including, but not limited to: falls from height, rope burns, muscle strains, sprains, fractures, head injuries, equipment malfunction, adverse weather conditions, and encounters with wildlife or natural hazards. I voluntarily assume all risks associated with my participation.

3. RELEASE OF LIABILITY

I hereby release, discharge, and hold harmless The Sandbox Resort, its owners, directors, employees, agents, instructors, and affiliated parties from any and all claims, demands, actions, or causes of action arising from my participation in the activities, including claims of negligence.

4. FITNESS & HEALTH

I confirm that I am in good physical health and have no medical conditions, injuries, or disabilities that would prevent safe participation, unless specifically disclosed in this form. I agree to inform staff of any changes in my health status before commencing activities.

5. SAFETY COMPLIANCE

I agree to follow all safety instructions, rules, and guidelines provided by The Sandbox Resort staff. I understand that failure to comply may result in immediate removal from activities without refund. I will not participate under the influence of alcohol or drugs.

6. MEDIA CONSENT

I grant The Sandbox Resort permission to use photographs or video recordings taken during my visit for promotional and marketing purposes, unless I explicitly opt out at the time of my visit.

7. PERSONAL PROPERTY

I understand that The Sandbox Resort is not responsible for loss, theft, or damage to personal property. I agree to secure my belongings and remove jewellery, loose items, and accessories as instructed before participating in activities.

8. GOVERNING LAW

This waiver shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising from this waiver shall be resolved through arbitration in Nyeri County.
